These Terms govern your use of the Kova Fitness app, website and related services (“Services”). Kova Fitness is operated by Coastline Group Service (“we”, “us”, “our”). By using the Services, you agree to these Terms.

1. Accounts and eligibility

Provide accurate account information and keep credentials secure. You are responsible for activity through your account. Kova is not directed to children under 13; any higher local age or parental-consent requirement also applies.

2. Fitness and nutrition

Kova is a fitness, training, running, recovery and nutrition tracking tool, not medical advice, diagnosis or treatment. Exercise and nutrition involve individual risks. Consider your circumstances and seek qualified professional advice where appropriate. Stop exercising and seek appropriate assistance if you experience concerning symptoms.

3. Estimates and accuracy

Calories, macros, pace, distance, energy expenditure, targets and other metrics may be estimates affected by user input, sensors, GPS and third-party data. Food information may be incomplete or outdated; check authoritative sources when accuracy matters.

4. GPS and health integrations

Location features depend on permissions, GPS, hardware and operating-system behaviour and may contain errors or gaps. Apple Health/HealthKit features operate only where supported and authorised by you.

5. Acceptable use

Do not misuse Kova, attempt unauthorised access, interfere with security, introduce malicious code, impersonate others, infringe rights or use the Services unlawfully.

6. Intellectual property

Kova software, branding, interface, designs, graphics and content are owned by or licensed to Coastline Group Service. You receive a limited, personal, non-exclusive, non-transferable and revocable right to use Kova for its intended purpose.

7. Third-party services

Kova may rely on third-party infrastructure, authentication, food databases, Apple services and device functionality. Third-party services have their own terms and policies. Nothing here excludes responsibility that cannot lawfully be excluded.

8. Purchases and subscriptions

If paid features are offered, price, billing period, trial terms and included features will be shown before purchase. App Store purchases are processed by Apple and subject to applicable Apple terms. Auto-renewable subscriptions renew until cancelled through the applicable App Store subscription settings. Nothing in these Terms excludes rights under the Australian Consumer Law.

9. Availability

We may update or discontinue features and may suspend access where reasonably necessary for maintenance, security, legal compliance or misuse. We do not promise uninterrupted or error-free availability.

10. Account deletion

You may initiate permanent account deletion through Profile → Delete Account. We may suspend or terminate access for serious or repeated breaches, security risks, unlawful use or where required by law.

11. Consumer rights and liability

Our Services come with guarantees that cannot be excluded under the Australian Consumer Law where it applies. Nothing in these Terms excludes or modifies rights, guarantees, remedies or liabilities that cannot lawfully be excluded. To the maximum extent permitted by law, liability for indirect or consequential loss is excluded where such exclusion is lawful.

Our Privacy Policy explains how we handle personal information.

13. Changes

We may update these Terms as Kova, law or our practices change. The current version and update date will be published here, and we will take reasonable steps to notify users of material changes where appropriate.

14. Governing law

These Terms are governed by the laws of New South Wales and applicable Commonwealth laws, subject to consumer rights that require otherwise.
